Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Bijou mobile application, related services, and the website at meetbijou.com (collectively, the "Services") operated by Bijou ("Bijou," "we," "us," or "our").

By downloading, accessing, or using the Services, you agree to be bound by these Terms and our Privacy Policy, available at https://meetbijou.com/privacy-policy. If you do not agree, do not use the Services.

We may offer beta, early access, or experimental features. Those features are provided as-is and may change or be discontinued at any time.

Bijou is intended solely for adults. You must be at least 18 years old to create an account or use the Services.

By using Bijou, you represent and warrant that you are at least 18, have the legal capacity to enter into these Terms, and are not prohibited from using the Services under applicable law.

You may not use the Services if you have been previously removed or banned from Bijou.

You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.

You agree to provide accurate, current, and complete information and to keep your profile information updated.

You may not create an account on behalf of another person, impersonate anyone, or use a false identity.

Notify us promptly at support@meetbijou.com if you believe your account has been compromised.

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use the Bijou app on Apple-branded devices that you own or control, solely for your personal, non-commercial use.

You may not copy, modify, distribute, sell, lease, reverse engineer, or attempt to extract the source code of the Services except as permitted by law.

All rights not expressly granted to you are reserved by Bijou and its licensors.

You are solely responsible for your content and interactions on Bijou, including photos, messages, voice inputs, profile information, and responses to prompts.

You agree not to use the Services to:

• Harass, threaten, abuse, defame, stalk, or harm another person.
• Post content that is illegal, hateful, sexually exploitative, violent, fraudulent, or otherwise objectionable.
• Solicit money, passwords, financial information, or personal data from other users for improper purposes.
• Use the Services for commercial solicitation, spam, or unauthorized advertising.
• Upload content you do not have the right to share, including another person's photos or private information without consent.
• Attempt to scrape, reverse engineer, disrupt, or interfere with the Services or other users' experience.
• Use bots, automation, or artificial means to manipulate matching, messaging, or rankings.
• Circumvent safety features, reporting tools, or access restrictions.

Bijou does not conduct criminal background checks on users unless explicitly stated in the app. We do not guarantee the identity, intentions, or behavior of any user.

You are solely responsible for your interactions with other users, including any communication or meeting offline. Use caution and meet in public places when choosing to meet in person.

Bijou is not responsible for the conduct of any user on or off the Services. Report suspicious or harmful behavior through in-app tools or by contacting support@meetbijou.com.

Bijou includes AI-powered features such as matchmaking assistance, compatibility insights, voice interactions, message suggestions, and profile tools.

AI outputs are generated automatically and may be inaccurate, incomplete, or inappropriate. They are provided for informational and assistive purposes only and should not be relied upon as professional, legal, medical, psychological, or relationship advice.

You remain responsible for what you send, publish, or act on through the Services, including content suggested by AI.

Bijou may offer paid features or subscriptions, such as Bijou Plus (or similarly named offerings). Prices, features, and availability may vary by region and may change over time.

If you purchase a subscription through the Apple App Store, payment is charged to your Apple ID account. Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period.

Your account will be charged for renewal within 24 hours prior to the end of the current period. You can manage or cancel subscriptions in your Apple ID Account Settings after purchase.

Any free trial, if offered, converts to a paid subscription unless canceled before the trial ends. We do not control Apple's billing processes and refer you to Apple's terms for payment-related issues handled by Apple.

Except where required by applicable law or Apple's policies, payments are non-refundable by Bijou. Refund requests for App Store purchases must be directed to Apple.

Our Privacy Policy explains how we collect, use, and share information. By using the Services, you acknowledge that you have read our Privacy Policy at https://meetbijou.com/privacy-policy.

We may suspend or terminate your access to the Services at any time, with or without notice, if we believe you violated these Terms, created risk or legal exposure for us or other users, or for any other reason in our discretion.

You may stop using the Services at any time and may request account deletion by contacting support@meetbijou.com, subject to our Privacy Policy and legal retention obligations.

Sections that by their nature should survive termination will survive, including ownership, disclaimers, limitations of liability, and dispute provisions.

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not warrant that the Services will be uninterrupted, secure, error-free, or that matches, introductions, or AI outputs will meet your expectations or lead to any particular outcome.

Some jurisdictions do not allow certain disclaimers, so some of the above may not apply to you.

To the maximum extent permitted by law, Bijou and its officers, directors, employees, agents, and affiliates will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, data, goodwill, or other intangible losses, arising out of or related to your use of the Services.

To the maximum extent permitted by law, our total liability for any claim arising out of or relating to the Services or these Terms will not exceed the greater of (a) the amount you paid us for the Services in the twelve (12) months before the event giving rise to the claim, or (b) one hundred U.S. dollars (USD $100).

Some jurisdictions do not allow limitations of liability, so some of the above may not apply to you.

You agree to defend, indemnify, and hold harmless Bijou and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Services, your content, your interactions with other users, or your violation of these Terms or applicable law.

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law principles, except where mandatory consumer protection laws in your country of residence require otherwise.

Before filing a claim, you agree to contact us at support@meetbijou.com and attempt to resolve the dispute informally.

Except where prohibited by applicable law, you and Bijou agree that any dispute not resolved informally will be brought in the state or federal courts located in Delaware, and you consent to personal jurisdiction in those courts.

If you downloaded Bijou from the Apple App Store, the following additional terms apply:

• These Terms are between you and Bijou only, not Apple. Bijou is solely responsible for the Services and their content.
• Apple has no obligation to provide maintenance or support for the Services.
• In the event of any failure of the Services to conform to any applicable warranty, you may notify Apple and Apple may refund the purchase price (if any) for the app to you. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the Services.
• Apple is not responsible for addressing any claims by you or any third party relating to the Services, including product liability claims, failure to conform to legal requirements, or consumer protection claims.
• Apple is not responsible for investigating, defending, settling, or discharging any third-party claim that the Services or your use of them infringe that third party's intellectual property rights.
• You represent that you are not located in a country subject to a U.S. Government embargo or designated as a terrorist-supporting country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
• Apple and Apple's subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance of these Terms, Apple will have the right to enforce them against you as a third-party beneficiary.

We may modify these Terms from time to time. When we do, we will update the "Last updated" date above.

Material changes may be communicated through the app, by email, or on our website. Your continued use of the Services after the effective date of updated Terms constitutes acceptance of the changes.
